Weinbaum P.A. offers an initial evaluation  for a flat fee [typically starts at $1,000 and goes as high as $2,500 or more], in which Weinbaum P.A. will meet with you once by phone or webcam to provide oral advice as to whether or not there is at least one issue to raise on appeal that has merit.  In order to provide this limited advice, Weinbaum P.A. will require a brief review of the key documents and pleadings in your case and perform limited legal research into the potential appellate issues.  If Weinbaum P.A. deems the appeal to be lacking in merit then Weinbaum P.A. will not be able to represent you in the appeal.  This initial evaluation is very beneficial to you because it helps you determine whether or not you should pursue an appeal.​

An initial in person appellate consultation is a brief discussion regarding the appellate process, the background of the case, the nature of the appeal and an estimate regarding fees.  There is $200 cost for an initial in person consultation.  This initial consultation does not include reviewing documents or performing legal research.  It is limited to one hour.  If additional time is needed then you will be charged $200 per hour.

 Weinbaum P.A. represents appellate clients on either an hourly basis or on a flat fee basis.  Weinbaum P.A. does not take appellate cases on a contingency basis. Expenses are not included.  

All fees and expenses listed below are just to give you an idea.  Each case is different and thus the fees and expenses in your case may be more or less than the ranges provide below.  Moreover, this page is not a fee agreement, does not create an attorney client relationship and is just for informational purposes.

Weinbaum P.A. will charge a basic flat fee for Representing an Appellee, which will typically cover reviewing the Initial Brief, reviewing the record on appeal, researching and preparing an Answer Brief, requesting extensions of time, and communicating with opposing counsel regarding extensions of time.  This basic flat fee does not include additional services, such as, but not limited to, preparing for and attending oral argument, preparing other appellate motions [examples: Fla. R. App. P. 9.330 motions, motions to dismiss, motion for attorney fees, etc.,] and preparing appellate responses [examples: response to 9.330 motion, response to motion for attorney fees, etc.] .  It does not include expenses.  If other work is needed during the appeal, in which the basic flat fee does not cover then you will either pay for this additional work on an hourly basis or another flat fee will be agreed to prior to starting this additional work. 

A basic flat fee for representing an Appellee starts at $5,000 (for a simple appeal) and may go as high as $20,000 or more (in a complex appeal).

Clients that choose to hire Weinbaum P.A. on a flat fee basis must generally pay the basic flat fee before Weinbaum P.A. begins to work on the case.

Weinbaum P.A. has decided to start offering to handle appeals on a flat-fee basis, as opposed to charging by the hour.  Flat fees provide clients with certainty about the fees.  The flat fee will depend on the length of the trial court proceedings, the size of the record, the number of likely issues and their complexity, and whether Weinbaum P.A. is bringing or defending the appeal. 



APPELLATE FEES

The fee does not cover expenses.  The Client is responsible for all expenses. The typical expenses with regards to a final appeal include, but are not limited to:  


  • Court filing fees  (For example, $100 paid to the circuit court and $300 paid to appellate court) 
  • Preparation of Record on Appeal, which is paid to Clerk of the Lower Court (For example, it can cost as low as $200 (which, included the record of a 1 day trial)  or even as high as $3,500 ( which included the record of a 6 day trial))  
  • Preparation of Transcript, which is paid to the court reporter  (Ranges could be from  $220 (Short hearing - 70 page transcript) to $10,000 (6 day trial))
  • Other Expenses (Postage, Copies from Court File, Out of Town Travel [if not within Broward County, Miami-Dade County and Palm Beach County], etc.).


In general, payment of expenses is required in advance.  The funds are deposited in a trust account. At the time a bill is due, if there is an expense deposit in the trust account, the expenses billed by the firm shall be disbursed from the firm's trust account to the firm's operating account.  Some expenses may be paid directly from the trust account to the third party provider.  Some expenses may be paid directly from the client to the third party provider.

Weinbaum P.A. will charge a basic flat fee for Representing an Appellant on Appeal, which will typically cover filing the notice of appeal (if not already filed), preparing and filing designation to court reporter (if appropriate), preparing and filing directions to court clerk (if appropriate), communicating with the client, reviewing the record on appeal, researching and writing the Initial Brief, preparing routine procedural motions that are needed to complete the Initial Brief, requesting extensions of time (if needed), communicating with opposing counsel regarding extensions of time and routine procedural motions that are needed to complete the Initial Brief, reviewing the Answer Brief, making a recommendation as to whether or not a Reply Brief should be prepared and whether or not oral argument should be requested.   

This basic flat fee DOES NOT include additional services, such as, but not limited to, preparing the reply brief, preparing for and attending oral argument, preparing other appellate motions [examples: Fla. R. App. P. 9.330 motions, motion for attorney fees, motion for stay, etc.], and preparing appellate responses [examples: responses to motion to dismiss, response to 9.330 motion, response to motion for attorney fees, etc.] . It does not include expenses.  If other work is needed during the appeal, in which the basic flat fee does not cover then you will either pay for this additional work on an hourly basis or another flat fee will be agreed to prior to starting this additional work.   

A basic flat fee for representing an Appellant typically starts at $8,000 (for a simple appeal) and may go as high as $40,000 or more (in a complex appeal).

Clients that choose to hire Weinbaum P.A. on a flat fee basis generally must pay the basic flat fee before Weinbaum P.A. begins to work on the case.

The Client is responsible for all fees.  Weinbaum P.A. represents clients on an hourly basis.   This means that Weinbaum P.A. charges clients based on the amount of time spent working on the case, which may include, but is not limited to:​​​


  • Reviewing the record on appeal
  • Researching legal issues
  • Writing and preparing legal briefs, motions or other court filings
  • Engaging in case-related communications
  • Requesting extensions of time
  • Reviewing opposing briefs
  • Preparing for and attending oral argument, if necessary


Weinbaum P.A. charges time in minimum units of one-tenth of an hour.  Expenses are not included in the fee.

If you wish to hire Weinbaum P.A. on an hourly basis, attorney Lane Weinbaum's standard hourly rate is $200.00.  Clients that choose to hire Weinbaum P.A. on an hourly basis generally must pay a fee deposit before Weinbaum P.A. begins to work on the case.  This fee deposit will be placed in the trust account. At the time a bill is due, if there is a fee deposit in the trust account, the fees billed by the firm shall be disbursed from the firm's trust account to the firm's operating account.

The actual amount of the fee deposit required on your case, however, will depend on the amount of time Weinbaum P.A. expects to spend on your appeal.


Appellants should expect their appeal, to require anywhere from 40 hours (in very simple appeals) to more than 200 hours (in complex appeals).

​Appellees should expect their defense of the appeal, to require anywhere from 25 hours (in very simple appeals) to more than 100 hours (in complex appeals)
